Privacy statement
Translatio Comm.V recognises the importance of proper management of your sensitive details.
We process and protect your personal data with all due care, in accordance with the relevant laws and legislation. This privacy statement is intended to inform you about the personal details that we process, about the measures we have taken to protect them and about your rights in connection with your personal details.
The purposes for which we collect and process personal data
There are two situations in which you provide your own or a third party’s personal data to us: when you request an offer for translation services and when you engage us to perform translation services.
We will only process your personal data for the purposes for which your consent was given. Those purposes can be generally described as ‘the performance of services’. We will not use your personal data for any other purpose, such as direct mailing campaigns or any other type of acquisition or advertising and we will not disclose your personal data to thirds.
Protecting your personal data
Your personal data – both in digital and hard copy formats - are protected in compliance with the minimum statutory requirements. In addition, we will not keep your personal data for any longer than necessary to complete the assignment, unless required by law.
As soon as your personal data are no longer needed for carrying out the assignment, we will destroy them.
Your rights under the GDPR (General Data Protection Regulation)
Use the model form you can request from Translatio Comm.V via email to exercise your rights as a data subject under the GDPR. Pursuant to the GDPR, you, the data subject, have the following rights:
- the right to inspect your personal data.
- the right to have your personal data erased.
- the right to correct your collected and processed personal data or right to restrict processing thereof.
- the right to data portability (the right to retrieve your personal data in the form and format in which you supplied them).
We will deal with your request within the statutory period set for this purpose. If your request is rejected, we will give reasons for our decision.
Loss of your personal data
Translatio Comm.V has taken measures to minimise the risk of loss of your personal. Should, despite our efforts, a data leak nevertheless arise in which your personal data are lost, we will inform you without delay.

General Terms & Conditions
These General Terms & Conditions shall apply to all transactions and agreements between Translatio Comm.V and the principal. The principal's conditions shall not apply, unless agreed otherwise in writing.
Article 1 - Offer
The principal may request an offer or cost estimate without any further obligation. The contract shall take effect on the acceptance of the offer submitted by Translatio Comm.V by the principal in writing.
Article 2 – Alteration or withdrawal of confirmed orders
2.1 If the principal makes any alteration to the original order, after the contract has been concluded, Translatio Comm.V shall be entitled to adapt the lead time and/or remuneration or to reject the order.
2.2 In the event of an order being withdrawn by the principal he shall be liable for payment of that part of the order that has already been executed, as well as a compensation of 50% covering the portion of the order that has not been executed.
Article 3 – Payment
3.1 Payment shall be transferred by the principal within thirty (30) days as of the invoice date into Translatio Comm.V’s account.
3.2 Translatio Comm.V is at all times entitled to require full or partial payment in advance, or surety.
3.3 In the event that an order is carried out in parts, Translatio Comm.V has the right to draw up separate invoices for each part of the order.
3.4 When timely payment is not effected, interest is due by the principal as from the due date of the unpaid amount that is equal to the legal interest raised by 2%, this without any requirement of reminder or notice of default. All costs in and out of court incurred by Translatio Comm.V in relation to the collection of the amount due are to the account of the principal in default.
3.5 Costs of collection are due by the principal in each instance in which Translatio Comm.V has assured himself of the help of third parties for the collection.
Article 4 - Duration and Delivery
4.1 If the principal has not explicitly agreed a delivery date Translatio Comm.V has the right to determine the time in which the agreement shall be executed to its own reasonable discretion.
4.2 When the order is changed, Translatio Comm.V is entitled to extend the delivery date without being bound to pay any type of compensation.
Article 5 - Non-fulfilment and termination of the agreement
5.1 In the event of the principal failing to honour his commitments, or in the case of bankruptcy, moratorium, receivership or liquidation of the principal's business, Translatio Comm.V shall be entitled wholly or partially to rescind the contract or to delay the execution of the order, such action never rendering Translatio Comm.V liable for any claim for damages.
5.2 If one of the circumstances stated in this article occurs, all claims by Translatio Comm.V on the principal shall immediately become fully payable and Translatio Comm.V shall have the right to suspend or terminate all other agreements with the principal.
Article 6 - Liability
6.1 Translatio Comm.V shall not be liable for damages incurred by the principal as a result of non-execution, the untimely execution or incorrect execution of the agreement, unless the damages are caused directly by Translatio Comm.V.
6.2 The liability shall in every case be limited to a sum equal to the invoice value excluding value-added tax of the order.
6.3 Translatio Comm.V shall never be liable for damages ensuing from a translated text by Translatio Comm.V that is incorrect or incomplete.
6.4 The principal indemnifies Translatio Comm.V against claims by third parties.
6.5 Translatio Comm.V shall not be held responsible for damage to or the loss of documents, information or information carriers placed at his disposal for the purpose of executing the order. Nor shall Translatio Comm.V be held liable for damage arising from the use of information technology or means of telecommunication.
6.6 Translatio Comm.V shall not be held responsible for the accuracy of information supplied to him by the principal and shall on no account accept liability for damage of any kind if Translatio Comm.V has operated from inaccurate or incomplete information supplied to him by the principal, even if such information was supplied to him in good faith.
Article 7 - Intellectual Property
The principal shall indemnify Translatio Comm.V from any claim by a third party regarding alleged breach of rights of ownership, patent, authors' copyright or other intellectual property in connection with the execution of the work.
Article 8- Complaints
8.1 The principal shall report complaints concerning the work delivered by Translatio Comm.V by registered post within 8 (eight) business days after receipt thereof. Reporting of a complaint shall in no way relieve the principal of his obligation to pay for the work delivered.
8.2 Should the complaints be well-founded, Translatio Comm.V shall correct or replace the work within a reasonable period of time, or - if Translatio Comm.V cannot reasonably comply with this request - agree to a reduction in the fee.
8.3 The principal's right to make a claim shall cease if the work has been published, c.q. used, c.q. passed on to a third party.
Article 9 - Force Majeure
In case of force majeure the services and other responsibilities of Translatio Comm.V shall be postponed. In such cases, Translatio Comm.V will complete the stipulated services as soon as this is reasonably possible. Force majeure may occur regarding persons and/or materials which are normally employed in the execution of the order. In such cases the execution of the contract may become even inconvenient or impossible to a high degree as well as disproportionably costly. Therefore the principal cannot in all fairness expect Translatio Comm.V to adhere to the terms of the contract. Force majeure shall include government measures, company technical breakdown, malfunction in the delivery of translations, labour strikes, exclusion, obstruction by a third party, unforeseen technical complications for both parties, and the like.
Article 10 – Applicable law - Competent court
Belgian law shall be applicable to all agreements, c.q. transactions between the principal and Translatio Comm.V. The Court of First Instance in Bruges (Belgium) is competent to settle any disputes ensuing from the agreement concluded between the principal and Translatio Comm.V.
In the event of discrepancies between the original Dutch version of our General Terms & Conditions and this translation, the Dutch text shall prevail.
